1. Who we are
These Terms and Conditions of Use (the "Terms") govern the use of the Orbitv application and related services (the "App" and, together with any associated websites and interfaces, the "Service"), owned and operated by:
In these Terms, "Orbitv", "we", "us" or "our" refer to General Broadcast SpA, and "you" or "User" refers to any person who installs, accesses or uses the Service.
By installing, accessing or using the Service you acknowledge that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, available at https://orbitv.io/privacy, which is incorporated by reference.
If you do not agree with these Terms, you must not install, access or use the Service.
2. Scope of the Service and platforms
Orbitv is a guide, discovery and personalization service for TV streamings available over the open web. Among other things, the Service may allow you to:
- Discover live and linear TV streamings from open and official web sources.
- Organize TV streamings by language, country, theme or other criteria.
- Create and manage favorites and frequently used TV streamings.
- Add your own legal TV streamings via the "My IPTV" / "Personal" features using supported formats (for example, M3U playlists or direct streaming URLs, such as .m3u8, .mpd, .mp4, etc.).
- Access advanced functions, such as themes, background audio, Picture-in-Picture (PiP) and extended mini-player, when you purchase eligible in-app products.
Orbitv is currently offered for:
- Android mobile and tablet devices.
- Android TV / Fire TV devices.
- iOS / iPadOS devices.
The App may be distributed through Google Play Store, Apple App Store, Amazon Appstore and/or other official app stores where Orbitv is made available from time to time.
Orbitv is not a telecommunications operator, cable / satellite provider, IPTV provider or pay-TV service. All of the TV streamings accessible through Orbitv are provided by independent third parties, who are solely responsible for the availability, legality, quality and content of those TV streamings.
We may modify, update, suspend or discontinue any part of the Service at any time, subject to applicable law.
3. Eligibility and age
The Service is intended for a general audience but is not directed to children under 16 years of age.
By using the Service, you represent and warrant that:
- You are at least 16 years old, and
- You have the legal capacity to enter into a binding agreement in your country of residence, or you use the Service under the supervision and responsibility of a parent or legal guardian.
We do not knowingly collect personal data from children under 16. If you believe that a child under 16 has provided personal data to us, please contact us at support@orbitv.io.
4. Network charges and devices
You are responsible for:
- Any costs arising from the download and use of the App, including data traffic and roaming charges applied by your mobile or internet service provider.
- Ensuring that your device and operating system meet the minimum technical requirements for using the Service and for accessing TV streamings over the internet.
Orbitv is not responsible for:
- The quality, availability or performance of your internet connection or your device; or
- The quality of service of the telecommunications access used by the devices where the App is installed.
A minimum download speed of 10 Mbps is generally recommended for optimal performance, although actual requirements may vary depending on the TV streaming and your device.
5. User account and guest use
Orbitv can be used:
- As a guest user, without registration; and/or
- With a registered account, where you create a profile and your data is stored on our servers.
If you create an account, you agree to:
- Provide accurate, current and complete information (for example, email address, username, date of birth and gender).
- Keep your login credentials confidential.
- Be responsible for all activities carried out using your account.
We may suspend or terminate accounts that we reasonably believe are being used in breach of these Terms or of applicable law.
6. In-app purchases and subscriptions
Orbitv offers free access with advertising and optional paid products managed via the app stores' billing systems.
6.1 Types of in-app products
Currently, the main in-app products are:
- Orbitv+ (one-time purchase)
- One-time, non-expiring product.
- Effects (on compatible Android and iOS / iPadOS mobile devices):
- Removal of advertising inside the Orbitv app controlled by Orbitv (such as banners, interstitials and in-app video ads before or around content playback).
- Access to additional color themes (for example, orange and pink themes).
- This does not remove or block any advertising, banners or pop-ups displayed on third-party websites or TV streamings that you access via Orbitv, including advertising embedded in the live TV streaming itself or on external web pages.
- Not available on Android TV / Fire TV.
- Orbitv Pro (auto-renewing subscription)
- Auto-renewing subscription with periods of 1, 6 and 12 months, depending on the option you choose.
- On compatible Android and iOS / iPadOS mobile devices, and depending on the version of the App and your operating system, it may include:
- Removal of advertising inside the Orbitv app controlled by Orbitv (same scope as Orbitv+).
- Access to additional color themes (for example, orange and pink).
- Background audio for supported TV streamings (subject to OS restrictions and streaming-type support).
- Picture-in-Picture (PiP) on supported devices and TV streamings.
- Extended audio / video mini-player within the App.
- These advanced functions are not available on Android TV / Google TV / Fire TV.
- Specific behavior may vary by device model, operating system version and the technical implementation of each TV streaming source.
- Variants for older operating-system versions (such as "Orbitv X")
- In some territories or app stores, we may offer technical variants of Orbitv Pro (for example, "Orbitv X") for older Android / iOS / iPadOS versions.
- These variants are subscription products with similar characteristics and are also managed by the respective app store.
Only the first subscription you purchase for 6- or 12-month periods may include a 7-day free trial, when offered by the relevant app store in your country. The 1-month subscription does not include a free trial. Trial availability and conditions depend on the app store's rules and may vary by territory.
6.2 Billing, renewal and management
- All in-app purchases are processed exclusively through the app store where you downloaded the App (for example, Google Play Store or Apple App Store).
- The accepted payment methods, billing cycles, currencies and applicable taxes are determined by the app store, not by Orbitv.
- Subscriptions will automatically renew at the end of each billing period unless you cancel them in advance through the subscription management section of the relevant app store.
- You can review, manage or cancel your subscriptions at any time through your app store account settings.
- If a renewal payment cannot be processed, the app store may grant a grace period for you to update your payment method; if you fail to do so, the subscription may be cancelled.
Orbitv does not have access to your full payment details (such as credit card numbers). Any refunds, billing disputes or payment-method issues must be handled primarily with the app store, without prejudice to any assistance we may provide in good faith.
6.3 Linking to store accounts and interoperability
In-app products (including Orbitv+ and Orbitv Pro):
- Are linked to the app-store account with which you completed the purchase.
- Can be restored on a new device using the "Restore purchases" option within the App, provided you use the same app store account and ecosystem.
- Do not offer interoperability between different ecosystems (for example, purchases made on Android cannot be used on iOS / iPadOS, and vice versa).
7. Advertising and commercial communications
Orbitv is financed in whole or in part through advertising. By using the Service, you understand and agree that:
- Advertising may be displayed in various sections of the App (for example, banners, interstitials and in-app video ads), unless you have purchased an eligible in-app product that removes such ads.
- When you access third-party websites or TV streamings through Orbitv, those third parties may display their own advertising and tracking technologies, which are not controlled by Orbitv.
- The products and services advertised are the sole responsibility of the respective advertisers and third parties.
We may send you:
- Service-related communications (for example, changes to these Terms, technical notices, account messages).
- Marketing communications, including push notifications, in accordance with applicable law and your preferences. You can manage certain notifications within the App and/or through your device settings.
8. Third-party TV streamings and external websites
All of the TV streamings and external websites you can access via Orbitv are provided and operated by independent third parties.
Accordingly:
- Orbitv does not create, host or control those TV streamings or websites.
- Orbitv does not guarantee their continuous availability, quality, legality, language, geographic reach, age rating or suitability for any particular purpose.
- Any issues relating specifically to the content, quality or availability of a third-party TV streaming should primarily be addressed to the operator of that TV streaming.
When you access a third-party website or TV streaming, you do so under the terms, conditions and privacy policies of that third party, not under these Terms.
9. User-provided TV streamings - "My IPTV" / "Personal"
The "My IPTV" or "Personal" feature allows you to add your own TV streamings (for example, via M3U playlists or supported streaming URLs) to your personal Orbitv experience.
By using this feature to add one or more TV streamings, you acknowledge that:
- You are solely responsible for the legality, quality and origin of the URLs you provide.
- If you add or access TV streamings from unknown or unauthorized sources, you do so at your own risk and may be subject to applicable copyright laws and enforcement mechanisms, including the Digital Millennium Copyright Act (DMCA), the European Union Copyright Directive, the International Broadcaster Coalition Against Piracy (IBCAP) and similar legal frameworks.
- You should review applicable laws and regulations before using this feature.
Orbitv does not host, provide or claim ownership of any content added by users through this feature and cannot verify the legality of user-provided TV streamings.
You must not use the "My IPTV" / "Personal" feature to:
- Add or distribute TV streamings that infringe copyright or other rights (for example, unauthorized retransmissions of pay-TV, OTT or subscription platforms).
- Access or share TV streamings that are clearly illegal, pirated or non-authorized sources.
Orbitv may, at its sole discretion and without prior notice, remove, block or disable access to the application when we reasonably believe they may be illegal, infringing or contrary to these Terms or to app-store policies.
10. Acceptable use
You agree to use the Service lawfully and in good faith. In particular, you must not:
- Use the Service for unlawful, fraudulent, defamatory, hateful or otherwise objectionable purposes.
- Attempt to access, modify or interfere with servers, APIs or other systems used to provide the Service.
- Engage in unauthorized automated access (for example, scraping, bulk downloading or automated capturing of TV streamings).
- Circumvent, remove or interfere with any security measures or technical protections, including those intended to protect intellectual property or to enforce geographic or device-based restrictions.
- Use the Service in a way that infringes third-party rights, including copyright, neighboring rights, trademarks, privacy or data-protection rights.
- Create multiple accounts or otherwise manipulate the Service to abuse free trials, promotions or subscription rules.
We may suspend or terminate your access to the Service if we reasonably believe you are violating these Terms or applicable law.
11. Intellectual property
Unless otherwise indicated:
- The App, its code, design, trademarks, logos, user interface, databases and other elements unique to Orbitv are the intellectual property of General Broadcast SpA or its licensors.
- Third-party brands, logos and other identifiers appearing in the Service are the property of their respective owners and are used for identification or descriptive purposes only.
You are not allowed to:
- Copy, modify, adapt, translate, reverse engineer, decompile or create derivative works of the App or the Service, except where such acts are permitted by mandatory law.
- Remove, obscure or alter any proprietary notices (including copyright and trademark notices).
- Use any Orbitv trademark without our prior written consent.
12. Privacy and data protection
Your use of the Service is also governed by our Privacy Policy, available at https://orbitv.io/privacy, which describes in detail:
- What data we collect (for example, account data, technical data, advertising identifiers, usage data).
- How we use that data (for example, to provide and improve the Service, to fight fraud, for analytics and for advertising personalization).
- With whom we share data (for example, app-store operators, advertising networks, analytics providers, push-notification providers).
- Your rights and choices under applicable data-protection laws (including GDPR, CCPA/CPRA and LGPD where applicable).
By accepting these Terms, you also acknowledge that you have read and understood the Privacy Policy.
13. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, if:
- You materially breach these Terms or applicable law.
- We are required to do so by a court, regulator or app store.
- We decide, for justified business or security reasons, to discontinue the Service in your region.
If your account is terminated without fault on your part, we will endeavor, where feasible, to give you reasonable prior notice.
Termination of your account or of your access to the Service does not affect:
- Any rights and obligations that, by their nature, should survive termination (for example, certain payment obligations, intellectual-property provisions or limitations of liability).
- Your ability to manage, cancel or claim refunds for subscriptions through the relevant app store according to its rules and applicable law.
14. Notice of alleged infringements (including DMCA)
If you are a rights holder and believe that any TV streaming or content accessible through Orbitv infringes your rights, you may submit a notice through our dedicated DMCA / copyright form at:
Your notice should include, at a minimum:
- Clear identification of the content or TV streaming you believe is infringing (for example, name of the TV streaming, URL, screenshots).
- Proof or explanation of your rights over the content or TV streaming.
- Your full contact details (name, email address and any other relevant details).
We will review your request and may, at our discretion and where appropriate, block or remove access to the relevant content or TV streaming, without prejudice to other actions that may be available under applicable law. Once the complainant enters the required information, they will be assigned a DMCA case number and notified at the email address provided on the form. GENERAL BROADCAST SpA will respond to the complaint by email within a maximum of five business days.
15. Disclaimer of warranties and limitation of liability
To the maximum extent permitted by law:
- The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement or availability.
- Orbitv does not guarantee that the Service will be uninterrupted, secure or error-free, or that any defects will be corrected.
- Orbitv is not responsible for:
- Failures or interruptions in your internet connection, your device, the app store or third-party services.
- Third-party TV streamings, websites or advertisements.
- Any loss of data or settings caused by technical issues not attributable to our willful misconduct or gross negligence.
To the maximum extent permitted by applicable law, Orbitv's total aggregate liability to you for any claims arising out of or relating to the Service will be limited to the amount you have actually paid to Orbitv (through in-app purchases) during the twelve (12) months immediately preceding the event giving rise to the claim, or to the minimum legally permitted amount if that is greater.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
16. Changes to these Terms
We may modify these Terms to reflect:
- Changes in the Service or in our business model.
- Changes in applicable laws or regulatory requirements.
- Security or technical reasons.
When changes are significant, we will endeavor to notify you through the App, our website, email and/or other appropriate channels. Your continued use of the Service after the changes become effective will constitute your acceptance of the updated Terms.
17. Governing law and jurisdiction
Unless mandatory consumer-protection rules in your country require otherwise, these Terms are governed by the laws of the Republic of Chile.
Any disputes arising in connection with these Terms or with the Service shall be submitted to the courts of Arica, Chile, and you and we expressly waive any other jurisdiction that may correspond, without prejudice to any alternative dispute-resolution mechanisms that may be available under applicable law.
